The present sale conditions govern contract relationships between JSA-TEC Sarl and its mail-order customers. Both parties accept these general conditions and understand that they refer to French law and take precedence over all other conditions. In the hereafter document « The Customer » refers to the person or company buying goods from JSA-TEC Sarl through its web site www.jsa-tec.com or by other mail-order means (phone, fax, letter).

JSA-TEC Sarl keeps the right to modify these sale conditions at any time.

Product Catalog
Photos added to product presentation are not contractual whatever the media (brochures, website,..). Therefore JSA-TEC Sarl can not be held responsible for aspect difference (color, shape) on the delivered products as long as the technical specifications are conform to the product description.

Pricing
All prices are in Euros. They include tax (rate 19,6%) but exclude shipping costs. JSA-TEC Sarl keeps the right to modify product prices at any time. Pricing given at the time of the order will be applied even if catalog prices have been modified in the meantime.

Payment
Product payment can be carried out in 3 ways :

1 – By credit or debit card :
No personal banking information goes through our website www.jsa-tec.com, the electronic payment is processed through the SPPlus secure server of the Caisse d’Epargne bank and will be debited only after JSA-TEC Sarl has validated the order.

2 – By wire transfer :
Customers will have access to our banking information (IBAN, SWIFT, and BIC codes) after selecting this mean of payment at the end of the order. They will also be added to the confirmation email the customers will receive following the order on our website.

Again the payment will be considered valid once the amount is credited on our bank account.

3 – By check :
The check needs to be addressed to JSA-TEC Sarl and sent to :

JSA-TEC Sarl retains the power to refuse any order from a customer with whom a contentious issue exists or a serious doubt on the payment validity remains. In case of a check payment, this check will be returned; in case of a electronic payment, the transaction will be withdrawn by JSA-TEC Sarl and the transaction amount will never be debited by the Caisse d’Epargne bank.

Shipping
All products are sent to the delivery address specified on the order. Shipments are made by postal mail with tracking number
(colissimo service) or by express service for professionals. Products will usually be delivered within 3 days in France and within 5 days for neighboring countries after payment reception and validation.

If the product packaging is opened, torn or altered in any way, customers have to inspect the products thoroughly and check their operation. If they appear broken or if you have any doubts, we recommend they refuse the delivery and detail the reasons on the delivery note. If for some reasons you are not present at delivery and the products have been damaged you have 3 days to notify the carrier by express letter. Please note that JSA-TEC Sarl can not be held responsible for any damage occurred during transportation.

In case part of the order or the complete order is not received within the specified time, please notify JSA-TEC Sarl as soon as possible. Indeed, all inquiry made after 6 months from the date of departure from our factory will be considered null and void.

Warranty
Customers have 7 full days after receiving the product to point out to JSA-TEC Sarl any malfunction. If the stocks permits, JSA-TEC Sarl will replace the product with a new one as soon as the faulty product will be returned by the customer and received at our factory. In case the product malfunction is due to an incompatibility with the customer’s vehicle but works properly otherwise, the customer will not be eligible for any replacement, refund or compensation from JSA-TEC Sarl as the vehicle requirements for product use are clearly specified in the product technical note.

The 1 year warranty covers JSA-TEC products and accessories for a normal use, as described in the product brochure. For simple problems, spare parts will be sent directly to the customer, who will proceed to the part exchange. If further dismantling is required, the customer will send the product at its own expenses to our factory: JSA-TEC Sarl – 15 rue Lanterne – 69001 Lyon. We will return the product fully operational within 30 days

The customer is also protected from hidden faults by the Civil Code (Art. #1625 and following).

Purchase cancellation and return items
According to the French Consumer Code (Articles L.121-16 and following) customers have the right to cancel a purchase within 7 days after receiving the product, if not satisfied with it. They can ask for a product exchange or a full refund, but in both cases the return shipping cost will be at their expenses.

In case of purchase cancellation, JSA-TEC Sarl has 30 days to refund the money received with the order. But the product has to be returned in perfect condition with the original packaging, all accessories and technical documentations. If not, customers lose their right of purchase cancellation and JSA-TEC Sarl will send the product back at the customer’s expenses. In order to guarantee product tracking all return items will be sent by premium postal mail with tracking number (colissimo service) or express service. JSA-TEC Sarl will not be held responsible for return items never received and for which customers have no tracking numbers.

Property
JSA-TEC Sarl keeps the property of delivered products until they are fully paid by customer. Nevertheless customers become responsible for the products as soon as delivery is effective, even if they do not fully own the products at the time.

Liability
JSA-TEC Sarl can not be held responsible for any damage or injury resulting from a faulty use or operation of sold products. JSA-TEC liability will be limited to the amount of the order and can not be blamed for simple errors or omissions that may remain in product presentations although all efforts to suppress them have been made

In addition, JSA-TEC Sarl can not be held responsible for failure to execute the contract for causes beyond its control; strikes in postal or carrier services, natural catastrophies.

Customer identification and confidentiality issues
All information collected during the ordering process (customer number, name, address), except the payment information, are stored on our server to ensure the best quality of service. But once the commercial transaction is completed and according to the January 6, 1998 law on personal data you have the right to access, modify, correct or suppress these personal information. Contentious issues
If a contentious matter was to appear between the parties regarding the validity, interpretation or execution of the present contract, the parties agree to address the matter to the Trade Court of Lyon, city where the JSA-TEC headquarters are located.
